Counsel for timeshare owners brought claims in federal court on behalf of 59 sets of timeshare owners, alleging they were defrauded into purchasing Wyndham timeshare interests and that Wyndham breached its contract with the owners by failing to provide access to and use of their timeshare interests. The court denied Wyndham’s motion to dismiss the complaints, ruling that the disclaimers in the timeshare contracts did not “cloak defendants with immunity” from fraudulent statements, if the contract was procured fraudulently.
