Order Denying in Part Bluegreen Motion to Dismiss

Smith v Bluegreen

The Court denied Bluegreen’s Motion to dismiss the Smith’s fraudulent concealment claim, based on Smith’s allegations that the timeshare developers’ sales representatives were licensed real estate agents who had a duty to disclose all adverse facts to all parties in a real estate transaction.
